How long does an eviction take in Orange County or Los Angeles County?

An uncontested residential eviction commonly takes about 5 to 8 weeks from the notice to the sheriff lockout. If the tenant contests the case it often takes 2 to 4 months. Since January 1, 2025 tenants have 10 court days to respond to the lawsuit, which added about a week to most cases.

Can I include late fees in a 3 day notice to pay rent or quit?

No. A residential 3 day notice to pay rent or quit may demand only rent that is actually due. Late fees, utilities, repair costs and other charges cannot be included, and an overstated amount can make the notice invalid.

Do the 3 days include weekends?

No. The 3 days to pay or comply do not count Saturdays, Sundays or court holidays. After the 2025 decision in Eshagian v. Cepeda, the notice itself should state when the 3 days begin and end and that weekends and holidays are excluded.

Can I change the locks or shut off utilities if the tenant does not pay?

No. Self help evictions are illegal in California and can lead to penalties. Only the sheriff can remove a tenant, after the landlord wins a court judgment.

Is my property covered by rent control or just cause rules?

Many are. The statewide Tenant Protection Act covers most rentals older than 15 years unless the lease contains the required exemption notice. The City of Los Angeles, unincorporated Los Angeles County, Santa Ana and other cities have additional local rules. We check coverage for your exact address.

How much does a tenant have to owe before I can evict in Los Angeles?

In the City of Los Angeles the tenant must owe more than one month of HUD fair market rent for the unit size. In unincorporated Los Angeles County the threshold is more than two months, effective spring 2026. Other cities may have different rules.

Can I evict to move into my own property?

Often yes, but under the Tenant Protection Act the owner or qualifying relative must move in within 90 days and live there at least 12 months, relocation assistance is owed, and local ordinances may add more requirements and payments.

What happens if the tenant files an answer?

We request a trial date, which is usually set within about 20 days of the request. Many cases settle before trial with a move out agreement.

What does the sheriff lockout involve?

After judgment the court issues a writ of possession. The sheriff posts a notice giving occupants 5 days to leave, then returns to put the owner back in possession.

How much can I collect as a security deposit?

Since July 1, 2024 most landlords may collect no more than one month's rent as a security deposit. A limited exception allows certain small landlords to collect two months.
