Eviction rules that apply in Ontario
- We are not aware of a Ontario rent control ordinance as of October 2026, so state law sets the rules for most rentals. Cities can add tenant rules quickly, so we confirm the current local requirements before any notice is served.
- The statewide Tenant Protection Act (AB 1482) applies to most rentals older than 15 years: just cause is required once a tenant has lived there 12 months, and annual increases are capped at 5% plus inflation (10% maximum), unless the lease contains the exact exemption notice the law requires.
- Since 2025 a 3 day notice must state the exact start and end of the notice period, exclude weekends and court holidays, give a real payment address, and say the landlord will retake possession (Eshagian v. Cepeda).
- Tenants now have 10 court days to respond to an unlawful detainer (AB 2347), so plan on roughly an extra week compared with the old 5 day rule.
Ontario eviction cases are filed in the San Bernardino County Superior Court. We handle nonpayment of rent, lease violations, holdover tenants, owner move in and other no fault terminations, and commercial evictions for Ontario owners and property managers.
How we handle a Ontario eviction
- Review. We confirm which state and local rules cover the unit, check the lease and the rent ledger, and identify the right notice.
- Notice. We prepare the notice (3 day, 30, 60 or 90 day) with the exact dates and content the law requires, and arrange proper service.
- Lawsuit. If the tenant does not pay or move, we file the unlawful detainer in the San Bernardino County Superior Court and have the tenant served.
- Default or trial. If there is no response within 10 court days we request a default judgment; if the tenant answers we request a trial date and handle settlement talks and the trial.
- Lockout. After judgment we obtain the writ of possession and coordinate the sheriff lockout so you get the property back.

How long does an eviction take in Ontario?
After the notice period ends, an uncontested eviction in San Bernardino County usually takes several weeks: the tenant has 10 court days to respond after being served, then the landlord can request a default judgment and the writ of possession, and the sheriff schedules the lockout. A contested case that goes to trial takes longer.

Online eviction notices are $150, and our filing packet for landlords who file the case themselves is $850. If you want an attorney to represent you, we quote a flat fee after a case review. Contested cases are also quoted after a case review. Court filing, process server and sheriff fees are paid separately.
Does Ontario have rent control or just cause eviction rules?
Ontario does not have its own rent control ordinance, but the statewide Tenant Protection Act (AB 1482) covers most rentals older than 15 years and requires just cause once a tenant has lived there 12 months.
Which court handles evictions for Ontario rental properties?
Unlawful detainer cases for Ontario properties are filed in the Superior Court of California, County of San Bernardino. The courthouse depends on where the property is located, and most filings are made electronically.
